In India, under Section 57 of the Copyright Act, moral rights or author's special rights are: right to claim authorship and right to restrain or right to claim damages for distortion or mutilation or modification of the work which is prejudicial to author's reputation. This Section indicates that moral right itself is right to claim for civil remedies. There is no express provision for penal sanctions against infringement of moral rights. However, Section 63(b) says that any person intentionally infringes or abets infringement of any other right conferred by this Act, except the right conferred by Section 53A shall be prosecuted.
