I have been asked for advice about this kind of situation, when there has been formal agreement to discontinue a collaboration. As long as one acknowledges the role of the previous collaborators in the data collection, is there any problem with developing a manuscript without "permission" from them? My question assumes that no specific agreement exists about what will happen if a collaboration ends.
Do both parties have access to all data?? Then you might have the interesting situation, that based on the same data two quite different conclusions might come forward.
If each party has (and uses) only its own data, than insufficient material might be present to produce an acceptable paper. This should be clear first - in my opinion - before I would give an advice in such a situation.
Generally, as long as you acknowledge in a reasonable way each contributing party, this might be acceptable to me. May be the editorial board of the Journal(s) might oppose, thus creating other complications.
Who is leading the research? What is the relationship with the collaborators?
If you lead the investigation is sufficient acknowledge the role of the previous collaborators.
I think is also important to ask, who own the data, which institution? both? This should be initially placed in an agreement between the institutions in order to avoid overlapping and/or duplicate publications.
Alfonso -- Yes, it SHOULD have been agreed to, but in this case it was not. The data does not belong to an institution. It is survey data collected outside the institutions of the respective researchers, who were equal partners and both regular faculty at their unversities.
