If all else is perfect and CFA and everything is good, except for discriminant validity, the AVE is less than the MSV - is there any article that could justify this?

It depends on the study objectives but it is not mandatory to comply with the discriminant validity if they meet the other measurement criteria.

Since the goal of discriminant validity evidence is to be able to discriminate between measures of dissimilar constructs the question arises that whether the other questionnaire is appropriate for counting discriminant validity.
