With AI now creating art, music, and even inventions, traditional IP laws—designed for human creators—are facing major challenges. Who owns the rights to AI-generated works: the user, the developer, or no one? Should new legal frameworks be developed? I’m seeking insights on how IP law should adapt to this rapidly evolving landscape.
The rapid emergence of Artificial Intelligence as an autonomous creative and inventive force has exposed significant gaps in existing Intellectual Property (IP) laws, which were fundamentally designed around human authorship, originality, and inventorship. Traditional frameworks—such as copyright, which requires human authorship, or patent law, which necessitates a natural person as the inventor—struggle to accommodate works generated independently by AI systems. The central legal dilemma revolves around authorship and ownership: Should the rights vest in the developer of the AI, the user who inputs the prompts or data, or should AI-generated outputs fall into the public domain due to the absence of human creativity? While jurisdictions like the UK and Australia have begun tentative recognition of computer-generated works under specific provisions, such approaches remain inconsistent and insufficient in the face of increasingly autonomous generative AI. To adapt, IP law must evolve through the creation of sui generis frameworks that define rights and responsibilities around AI outputs, possibly recognizing a collaborative or layered model of ownership where both developers and users hold partial rights depending on their input and control. Additionally, international harmonization will be essential to ensure cross-border enforceability and prevent regulatory arbitrage. Beyond ownership, the legal framework must also grapple with ethical and moral dimensions, such as attribution, economic incentives for creativity, and safeguarding against exploitative or biased AI content. Ultimately, a forward-looking IP regime must balance the promotion of innovation with the foundational principle of rewarding human ingenuity, while clearly delineating how machine contributions are to be recognized, controlled, and monetized in a globally connected digital ecosystem.
An interesting question. Intellectual property is personal property and can be owned only by real or legal persons.
The thinking machine capable of actual authorship is as yet a long way off. No machine is legally recognised as either a person or a corporation. It cannot be a person until independent sentience and proper cognitive function can be demonstrated and that has not even been remotely achieved.
In the case of a machine being recognised as a sentient person we would need an entire shift in our legal philosophy. We would be in the unenviable position of having to convey to it (He/She perhaps) some equivalent fundamental rights to those encountered in the UN Charter and numerous state constitutions. Our criminal justice systems would have to incorporate mechanisms for dealing with machine aberrant behaviour. It would have to be culpable in tortious acts and have capacity to enter contracts and hold positions as fiduciary.
In the case of an AI machine being a corporation who is the controlling mind? It would be remarkably difficult to maintain the corporate veil, which is already threadbare after centuries of company law engagement.
The issue is not the evolution of IP law alone, a thinking machine would necessitate a re-write of just about every human legal and ethical framework there is.
We perhaps need to be careful in the future that it is not the machine drafting our constitutions and legal codes. It is alarming enough that some politicians are already consulting AI in formulating policy.
