In short Explorers or inventors are our fore fathers; while researchers are current generation and future which benefits from the earlier pains....There is nothing to grouse, that is the difference between an EXPLORER and a RESEARCHER...But development doesnt stop anywhere, it is continuous and magical with the needs and demands of the society....Therefore the limitation of Copy wright is it covers Concrete, Raw and innovations which are for the first time occurrence, it however doesn't cover the iterations from the above mentioned classifications which are normally derivatives of the original or modernized versions or novelties....This is generic to wherever it is applied, whether it is to an university or common public...
All researchers should respect copyrights of others, since it is an ethical and a legal issueat the same time.
In my institute, there are strict instructions about copyright violation. It is considered as a breach of discipline to indulge in plagiarism or even self plagiarism. Even our students, who have to submit their dissertation reports as part of completing their MBA course, have to comply with these requirements. We have a plagiarism software installed in each faculty computer to know her/his level of plagiarism. Only about 10 % plagiarism is tolerated, which is the standard global practice.
I agree with you Mostafa, Mahfuz and Debi. In some cases the institution breaks the rules and thinks that the copyright is for them not for the researcher.

You can make your publication patented with cross reference when publication exsist.
I think the matter reduces to particular members of the organisation. In particular the organisation is responsible in creating a culture of respect to intellectual property.
@Hashem, but a publication couldn't comprise the hole work as a software or a system or a prototype. Patenting is efficient when it is fair and out of control from any third part. I have asked for a patenting years ago with a cross publication. unfortunately I haven't obtained any response.
I think research protocols with identified tasks and/or obligations , accepted and signed by the different parties (the research team members, the adviser, the institution officers and/or the funding agency), could bring a more efficient protection.
in my country, research protocols were a basis of each research work; The last decade this tradition was removed. Still patenting is not so efficient as it must works with industrial or enterprise research tradition that do not exists in many developing countries yet, in Algeria too.
