I am trying to form/develop my opinion on this matter. Summarised: if a forensic mental health patient progressed to the point of having unsupervised day leaves can he decide on his use of brothels/prostitues? Is there any literature available which has researched this? Will appreciate references - if there are. Thanks

Many thanks for the responses. As was said, we are not dealing with questions of criminality when it is legitimised in a country. Some issues are around providing treattment for relationship improvement on all fronts, but also condoning a superficial physical conact as a substitute for sexual meaning within a nurturing relationship. I also do not think it is necessarlily a risk factor, pending the individual make-up of the patient, presence of psychopathy, offence types and status of dynamic risk items.

Clearly someone who has been charged with a violent, sexual offense should not be encouraged to use brothels/prostitutes.
The goals of therapy are another important consideration. But this raises a fundamental therapeutic issue: to what extent should our therapy be designed to impose our moral values on our patients? This becomes apparent when your question about a patient's cognitive abilities -- can he decide -- is seen to be, in fact, a question about the patient's behaviour -- should he use.

Better late than never. This is a very good goal and should be put in question. Some people were not properply brought up and do not understand their own good!
If a patient were to utilise unescorted/unsupervised leave to the city or town, and go to a brothel, you would have to rely on the patient being honest about them doing so for the professional team to have an opinion on the matter.
I think that you have to know your patient and his case factors very well. this allows for a degree of risk assessment. Brothels, even in states where it is legal, are places that attract crime and drug misuse. there is also the question of sexual offending with Forensic patients.
The first consideration should be the person's index offense. Was it a crime against a person, i.e., a sex offense (then plainly the answer would be "No"), assault or domestic battery, etc.? Or was the index offense a crime against property? That is, something like arson, theft, etc. Even if it is legal, I would think it to be a negative influence in terms of psychiatric stability and eventual discharge.
