The data you are talking about is controlled data, there is nothing forbidden on GDC. It's just that you require special permission to access controlled data. You need to obtain an eRA account, there you will get access of dbGap portal, from there you have to fill up some of the specific information, like what project you are working on, funding agency detail, what are the expected outcomes, which of the particular data you want access to etc. . After that you will have to take print out of that form and get it signed by HOD or Director of the institution. Re-upload it and with in 2-3 days you will have access to that data.

It's just that due to some ethic, rules and regulations of US govt. and also scientific community all data is not public.
