Do you think that principles like rule of law and democracy can be judiciable?
Sunday the 29th of July, Romanians had to vote in the referendum concerning the impeachment of the president Basescu. Only 46.13% of the voting rights holders have participated and therefore the referendum has been invalidated (the rule is >50%) and the situation is almost as unclear as before the referendum since a huge majority of participants expressed themselves in favour of the impeachment of the president (87.5%, i.e. approx 40% of the voting rights holders would vote against the president). http://www.bbc.co.uk/news/world-europe-19034173
According to the latest polls, some additional 25% would vote against the president if the elections would be kept now, amounting to 65% of votes in favour of his removal. It is obvious that the system appears to be quite fragile and the conflicting parties try to use the absenteeism of the voters in their favour. It is also important to note that the referendum results are open to interpretation and must be placed in the general socioeconomic context, which is the mission of the political analysts to do.

On the 2nd of August 2012, the Romanian Constitutional Court has decided to postpone the decision on the invalidation of the referendum from the 29th of July. The reasons are related to the fact that the data on the size of the electorate do not correspond to reality. The population of Romania has shrunk during the last decade from 22 millions to about 19 millions due to a low birth rate and emigration. Therefore the results of the referendum had been analysed against the false premises.
The underlying political conflict has raised many concerns about the good functioning of the democratic institutions of one of the newest member states, I've attached below the official report from the European Commission. The European Union is founded on the rule of law and democracy principle and concerns related to the disregard of such fundamental principles must be taken very seriously. The nature of these legal principles is important in the context.
