I am doing a DNA extraction following the protocol of van der Beek et al. 1992. After the incubation at 65°C and posterior centrifugation, two phases are present plus the pellet; according to the protocol, it should transfer the supernatant into a new tube for further steps. There is this oily layer on top of the supernatant, and when one tries to go through it, it goes into the tip together with the supernatant.
Does someone have any ideas about what I am missing/ doing wrong?

It sounds like you are not doing anything wrong but the starting material is fatty/oily and that has formed a layer on the top. Try removing and discarding the oily layer first then process the watery supernatant as your protocol
Take the oily layer with the supernatant and make to them phenol choroform extraction and you will get rid of the oily layer.
