لا يمكن فلسفة كل شيء، فهناك مصالح، وربما مقاصد، واعتبارات، أما في التشريع فالقضية (قانونية)، هو قانون يقسم الإرث بهذا الشكل، والأفضل دراسة أسبابه ونتائجه، وليس البحث عن فلسفته، لأنه حينها ستكون النتائج شخصية ومتعددة ولن نصل إلى نتيجة علمية مفيدة.
