Recently I found the following patent in google scholar:
Patent No.: US 8,139,822 B2
Title: "Designation of a characteristic of a physical capability by motion analysis, systems and methods"
I'm no lawyer, but it seems to me that somebody patented or is trying to patent the standard data analysis methods that we have all been using for many years. Has anyone any comments on this?
If the method is already published there is no effect on the patent.
From my experience it is always necessary to adjust your experiments and analysis to your specific need. I can't really see how to cover all possibilities in one patent. Therefore, I do not think this will pose any kind of problems for your future work. Cheers

This is a really weird patent. It seems as though they are not attempting to patent motion analysis in terms of data collection, but rather the process of extracting meaningful measures and using that to compile some sort of score to rank individuals. I can't imagine that this patent is actually enforceable given how easy it would be to modify your procedures slightly and evade the methods they outline. I also don't really understand the motivation for patenting this. Really strange...
