I usually upload my published papers in RG with the comment that Uploaded full-paper is not for mass dissemination but just for students and colleagues. But today, I just got an email from RG that my public full paper got removed since it infringes the copyright of Elsevier.
I know what and how important the copyright is, but still as the one who put tremendous amount of time and effort for publication, I am sad that authors do not have right to read/share own papers.
My question is:
Well I know full paper upload in RG issue has widely been discussed but wonder alternatively, if it is legally fine just to upload (or maintain even after published version comes out) my own preprint (but word-by-word same as publisher's version), not a publisher's pdf version.
Please take the following golden advice for myself and you:
- For the coming future, do not upload any paper anywhere until it is published with your name. Even if it is a "preprint"!
- If you had done something like that as a "preprint", for instance, I advise you to delete the preprint and wait for two months before sending the paper to any journal.
This is because:
- There is a high chance that someone may claim your valuable thoughts as theirs.
- There is also a chance the someone may plagiarise your paper.
- A journal may have automated plagiarism software to check the paper before admitting it to the reviewing process. There are chances that your paper can get a rejection at any point. Thus, to avoid this problem. Publish the preprint after you got "Paper ACCEPTED".
Yes.the legality or illegality in downloading documents whether authored by you or not, largely depends on the terms and conditions put in place by the publisher, organization or the library.
It is therefore advice-able that before publishing your work in any format, a careful mastering of the publishers legal statements be undertaken. As copy right laws defer from one publisher to the other.
It totally depends on the contract you signed with your publisher.If you assign all your rights(except for authorship of course) to your publisher then there is no way for you to publish it, unless you ask for their permission as an implicit agreement which is rather to be in written(in my opinion)
