At the beginning of nanomaterial discoveries a decade or more ago, the patent office and other government agencies did not have enough materials to use as a basis for restricting patent claims and applications. Now that the databases are available, many patents way back during those years are now obviously too broad and unable to support the claims. Because of the existence of such kinds of patents new discoveries that are more substantially supported have to go around such broad patents.

But because of broad patents without substantial contents, there is still a huge backlog of patents in nanoscicence and nanotechnology in the US and worldwide to date. How can the backlog be resolved?
