One of the most complicated problems posed by the Internet, namely that of jurisdiction and lack of global criminal justice system. While cybercrime is a phenomenon without borders, the effective prosecution of such a crime is seriously hampered by conflicts of territoriality and jurisdiction.
Here are few thoughts:
1.The theory of ‘universal jurisdiction’ derives from the idea that a crime must reach a certain level of harm, or threaten the interests of the international community, before it can displace national law. Cyber crime still not recognized in that category of crime.
2. Cyber activities that are considered anti-social in one territory may be framed as criminal in another
3. On top of all, nations are becoming less co-operative and more isolationists.

The internet has a series of networks built on trust. However, the Internet is continually abused along the weaknesses in the Border Gateway Protocol and the Domain Name System, not designed to be secure . These inherent weaknesses are now being abused for online crime and espionage. Therefore, can states, and international organisations craft a binding treaty to contain rising cyber crime?
