The social rights have an specific nature. For that reason they are different of other freedom for exemple the freedom to make business or the fredom to have propertie.

I'm not sure because in your thesis you accept that the majority in Parliament can ignore the constitutional prescription. I think that all constitutional rights are the same position, even if some of these (not necessary the social rights or not only) ask for an implementation by the legislator.

Yes, human rights are particularly important and should be respected by all countries. Human rights should obtain a unique statue of international, globally applicable legal norms. However, some countries where there is no democratic rule of law do not respect these human rights. you affirm that human rights are important in an international level. It is true but there are not a global or International Parliament references of these rights, so they are completely guaranteed by the Courts . it is not the same . In the French revolutions are the Preamble, ore the constitutional paper that defense rights. There is a big difference, because the political level of defense is important , too. and yo are not this level in ONU charter for example. so, you are a minimum level that you can guarantee . Probably the best way to guarantee rights is now the national a constitutional protection.

Social rights are internationally accepted and accredited patterns of life ; but it varies from nations to nations and region to region and fully guaranteed by the Judiciary ( even in the village administration - of THE 3 TIER DEMOCRACY IN INDIA)@

If there is a difference between social and other rights it is a historical difference and not structural. All rights have a cost and each right has a different structure. During a social democracy social rights are built. they efficacy is the same of all other rights and there are binding in the same way.

I think when social rights are contained in a Constitutional Charter, they are binding as all the other rights...even the duty to provide with any instrument to satisfy rights by the State it is only a characteristic of Social rights. To providing tools to guarantees the right also applies to the apparatus of justice, I.e. to provide tribunals and it also applies to defend other freedoms.

Maybe you are looking into social extension only for labor rights and similar (like subject to European Social Charter 1961 rev.)?

the European social rights start to be applicate also in the national state as a international charter, not at the same level of constitutional rights. Its importance increases but not enough. and the specifical protection I snot so detailed like the constitutional protection or the ECHR . the meaning of social rights is not only a defining of rights that costs because all rights have a cost.
