Shouldn't the relative intensity be independent of the instrument conditions?

Yes it's possible, ambient temperature is the one of most important effective factor in XRD Analysis, increasing of temperature causes Atomic vibrations are increased so disarray is created in the crystal lattice and relative intensity will changed, furthermore Testing error must be considered.

The XRD intensity is different with different instrument because the energy of lase is different. Therefore, it is necessary to use one standard sample to check the intensity.

So if the relative intensity of 2 peaks is important (i.e. we need two peaks with a certain intensity ratio), how can we be sure which peak ratio is correct in the xrd patterns? Can softwares like highscore xpert plus help?

Make 2 intensity ratios of the same number of samples. For each, determine the mean intensity ratio and its standard deviation. The one with a small standard deviation will be the best. This is the usual statistics of measurements of various quantities.
