This nomenclature is essential in many Islamic countries and it is crucial to identify the patient for social reasons and marital status in case of conflict between newly married couples for future rights ....etc.
It could be but it is still subject to the Islamic Law / Policy set by your country. If there are certifications from the medical doctors saying that the patient's torn hymen is due to some aggressive activities such as sports and not sex-related activities, then it should be fine. More importantly, that's between Allah and the patient. If your country does not allow female to perform activities (even sports) leading to hymen tearing, then the healed hymen is still considered 'against the law' no matter what valid reasons are given.
Even after sexual assaults, we have some cases completely healed after partial tear in the free border of the hymen. The physical appearance of the hymen returns in some cases as if there was no incident.....
The point is: do you consider such case as a forensic physician "virgin"?

The woman who is being examined is, presumably being examined by you a doctor. One is tempted to suggest that the question "what is in the patients best interest?" to find your answer.
due to important religious and political impact in certain countries on individuals life's it is sometimes a dilemma to distingish between professional i.e. medical responsbility and cultural norm. What is in patients best interest should be the obvious ground to act in such way. Healing on natural way of the hymen should be though considered as 'virgin' in islamitic aspect.
Just wondering, if virginity is tested through an intact hymen... has it been considered that some women may not sustain hymenal damage post copulation depending on the hormonal levels at that point in time? It depend on how you define virginity in your "context" .
I think we can't judge about virginity solely by physical examination of the hymen,i.e coitus has not pathogonomic features to differentiate from other causes of hymenal tearing as accidents ,falls, iatrogenic ,manipulation ,....,although history taking and full evaluation of vaginal rugae ,labia minor and major ,...should be considered .
on the other hand we can have false virgin in an apparantly intact elastic hymen ,...so except special cases as rape of a child with severe genital damages,... we can't and shouldn't label every healed hymenal tearing as non-virgin thorough our examination
