The Treaty on European Union (TEU) in its Article 7, provides possibility to introduce sanctions against the Member-State which violates basic principles of the European Union. So this is a binding agreement for E.U member states when it comes to provide social rights to refugees who enter their countries. This however causes internal tensions as these immigrants
enjoy free living expenses when aboriginal citizens strive due to economic crises to make ends meet.
As I am positive about social rights, but I also think that over asserting them by considering immigration being as a humanitarian issue above legal aspects such as
- capacity of country to welcome them
- loosening legality criteria of asylum seekers from high level EU political decisions
- avoiding to consider long-term sustainability to government-founded living of refugee status foreigners
providing social rights has some objections and can even be considered a contested view.
As a result, Hungary, who is ruled by right wing politicians by exception to other EU states who are ruled by "new right" politicians has denied entrance and social rights to immigrants by using force against refugees on the border line with Serbia, and also using force against journalists, as well as limitation of fundamental rights of refugees due to state of emergency in two Hungarian provinces. As a result other member states demand strong reaction of the EU institution
