Dear Majuta, please try to go through Indian constitution and role of Supreme court of India on supremecourtofindia.nic.in. hope you will find it useful for your Question.
The most important role of the judicial system in the process of lawmaking, I think is the constitutionality control of the laws. In Romania, we have a Constitutional Court, which decides if a law or one article is constitutional before the law is published in the Official Monitor. After that, any person can, in an existing litigation, sustain that a law or one article is violating the constitution, and the case is send to Constitutional Court. You can find more about this on the website (English version) http://www.ccr.ro/en.
The answer is different and depends on legal culture of a particular country. If you want to read more about it and make a deeper research, please check for example proceedings of the Conference of European Conthstitutional Courts (link added).
To my perception, the main role of the Court and the broad judiciary is to implement and secure constitutional order, in this insight and mode, we are speaking very counter-majoritarian nature of this institution, as the founding fathers and authors of Federalist Papers indicated and put it definitely. Constitutional Court or other equivalent bodies within the same competencies and functions are main vehicles to ensure this paradigm in practical discourse. In this mode, I will offer you the newest publication published by the center for constitutional transitions at New York School of Law which covers broad theoretical and practical challenges in the global agenda, particularly its concrete dimensions at so-called Arab Spring politics landscape.
I only hope this source only trigger you to perceive the issue more systematic and coherent way. Please, find attached file.
