To human health, no difference, both are harmful and dangerous to human health. But from ethical point of view, the seller of damage food is more sincere that the seller of fake food. Both should not be encouraged anyway.
I can only add that food products must have labels. If the content is not properly written or has artificial substitutes, they are fake. Damaged packaging or expired term refers to damaged products.
Damaged items are ones that the packaging got damaged, cans dented, contents spoiled or past their expiration date. Fake items are like imitations with labels looking similar to the genuine items, perhaps made cheaply and processed under less than strict health regulations, may be damaging to health due to the presence of some ingredients or through adulteration.
Both should not be consumed. Fake food, with absorption of chemicals that compose it, may kill you. Not the same with any damaged food. Some food that pass the consumption date as yogurts can easily be consumed and in Europe, laws force distributors to give them away for free to humanitarian associations, even if distributors regularly end up with trials for not doing it, or spraying chlorine on edible items, so they don't have to give them for free. The main difference is about smell, it's in our gens, we humans luckily react to sulfurous smells and reject them. Fake food have no smell. Don't eat things that don't smell.
If the difference between a fake and a damaged food is large and identifiable:
A damaged food is that real food (for example prepared meat or vegetable salad with dressing) that by mistake in handling can be contaminated with toxins or bacteria (for example by faecal bacteria such as E.Coli and Salmonella); or due to a poor conservation process (failure in the refrigeration of products derived from meat or milk).
A false food, is what seems to be real but is actually faked. An example is the plastic rice that mixes with real rice. Also wheat flour to make bread, mixed with earth.
Another example of fake or counterfeit foods are. Corn tortillas made with corn dough mixed with olote (fibrous support of corn seed) This support "olote" plus its seed "corn" is called Elote)
Very subtle questioning, but we can distinguish how: a damaged food is related by chemical, physical and microbiological contaminations while a false food can be associated with the use of technological resources to imitate something good. Examples: A fruit contaminated with pesticides or by pathogenic microorganisms illustrates the first case. A mixture of various additives such as colorants, thickeners and flavorings to imitate a fruit pulp may illustrate an example of a false food. Often additives are contaminants. In this way, in some cases, there may be coexistence of a false and damaged food.
The problem is that most types of fake food look good and tasty. It contains dangerous flavors. This is dangerous for children who are getting used to and looking for such food. This is a serious problem for regulators.

Cooked foods spoil earlier than the uncooked foods because immediately after cooking bacteria's will find a way to invade the food with zero competition. The reason for these microorganisms existence is cooked foods has more moisture content, high temperature, and high acid range because of this food spoils so early.
