I had submitted a manuscript to the Canadian Metallurgical Quarterly on Aug 25, 2019.
A year later, its status is still "with editor" !!!
I have sent several emails to the journal that either handle it or let me withdraw, but unfortunately, none of my emails are answered.
In such a disrespectful and unprofessional situation caused by the journal, am I legally and ethically authorized to submit the paper to another journal?
I would first contact the editor with a deadline. If nothing is heard I would withdraw the paper with immediate effect an submit to another journal.
It is reasonable to wait up to 90 days for the change in the status to "Under Review". If not, alert the editor or simply withdraw or submit elsewhere. Some editors are as hard as diamonds. They never respond to authors queries.
Our group faced such situations for few manuscripts. We had submitted a manuscript to International Journal of Pressure Vessels and Piping, Elsevier on Jul 09, 2017 and it continued to be "With Editor" status until finally withdrawn on Jan 09, 2019.
You have submitted your manuscript to the journal, and a year later, its status is still "with editor". Some papers wait for more than one year to get the feedback from the journal. I would suggest that you later inform them through their e-mail stating that you want to withdraw your manuscript. Then you may send it to another journal.

I know a few journals that do not update the status of the article until the final decision generally. Your item may be in this category. However, I think it is your legal right to withdraw the manuscript. Anyway, that's your article.
Ethically, it is maybe not good to do that though it is your paper. Withdrawal may incur some loss (financially, time, and logistics) to the journal. I think the best thing to do is to write to the chief editor explaining your grievance. S/he can facilitate the peer review process by prompting the peer reviewer/ associate editor since they are often burdened with a lot of academic work.

Yes, you can. Just send message to the editor to inform him/her that you have decided to withdraw your manuscript.
