I’m not clear what this question is asking. “Marital rape”, in Australia, is not an offence but sexual assault is. regardess of whether the victim is a spouse or not.
I see marital rape as another form of physical abuse against the spouse. At the very least, it would constitute an assault on the spouse in which the perpetrator could be arrested by police officers responding to a domestic disturbance call.
I believe that non-consented sex should be rape regardless of those parties are married or not. If a spouse continuously refuses having sex without any clear reason, one can divorce his or her spouse. Forced sex between married couple should not be tolerated in our society as it is detrimental on marriage. Also, marital rape can be a form of sexual exploitation of a wife by her husband.
