If a journal is found to be a predatory publishing (where in initial phase was found to be good (based on website and responses)) after the manuscript has been sent. I wrote to the editor that I am withdrawing the manuscript, even after that the article is published. Now, should I forgo the research or fight to remove from their database
I have never been in a similar situation, so have no clear solution in mind.
Nevertheless, some issues could be considered:
1) Perhaps the reason why the Journal went ahead against your consent is because this was a paid journal case. They are for profit, so, they are applying no-refund or partial refund policies, which is a common practice in businesses. Non-paid competitive journals allow you to withdraw your manuscript up to the very end, just prior to actual sign-up of copyright papers ahead of print.
2) If the content of this research is precious to you and you feel that it has been 'wasted', you might tell the Journal to delete the article BUT without refund. This will give you higher chance to get it done. Then, you try to publish it in a different journal of your choice.
3) If 2 above cannot be done OR it was not a paid journal case, then you could build up a legal case for dismissing the will and rights of the author. This is tricky, we know, and it will be all the more if you already signed copyright papers and you gave up key rights. Usually copyright papers are signed within a specific legal jurisdiction. So, the place where the Journal operates can make the legal challenge a long distance and tedious process
Thank you for the answer Jae Park. In my case, it was a paid journal and I did not pay the money asked for and neither I have signed any copyright form to publish. (It was my bad not to look for the background check of the journal before sending it.)
