I have done Insitu many times but with Drosophila eggs and i've had background signal. It is natural that a background appears though it is faint. It seems in your case, in the nuclei the background should be minimized due to a healthy probe-DNA/probe-RNA binding. Try out Lale's way, I believe it will work perfectly.
