sorry for a late response. I am currently working for the Federal Govt, in one of the largest departments and am assisting with the formation of the response to the AG third gender option legislation to be implemented by all Federal Govt departments for customers and staff by July 2016.

I am also friends with Norrie. The remarkable person that fought all the way to the High Court to have the legislation changed to allow her gender to be recorded as "x".

Am i able to be of any assistance?

Most definitely. I gradually precise the contours of my basic question. In addition, with the help of recent French university in law.

So, having identified the better legal operation of Australian institutions, the question that concerns me currently is:

What have the major essential fundamental laws and valid for any Australian who preceded and allowed the current situation to Norrie?

For example: recently, when I shared about it with Norrie, Norrie has put forward one of the articles of the constitution of human right. But Norrie is not jurist and, although it is a fundamental principle, I am not sure that going back to the source of the great principles Australes human rights laws are part of the constitution.

Do you understand what drives the center of a part of my job? Return gradually to a principle that would dominate the other and on which all laws on gender identity should build.

May I confirm that you are looking to see what laws have been adjusted to allow the recording of the non-binary gender option?

France is a coded state and Australia while heavily legislation still relies on "judge made" \common law. 

I can list the laws on a Federal level that have adopted the third gender option since the  High Court decision. This has most been directed by the Attorney General's office.

www.ag.gov.au  there is a number of submissions plus the AG's office paper for all Federal Govt offices to be completed no later than 1 July 2016

Certainly in Australia the "judgment makes the law", but the judges are necessarily based on some fundamental principles, and this is the meaning of my question. If the judgment of Norrie could be any time in history (it was 20, 30, 50 years, for example) or if some changes in the law have allowed the non-specific nature. For example, Norrie told me about some activists who helped draft and lobby for legislative changes in 1996: Aidy Griffin, Jill Hooley and Nadine Stranssen. Could you teach me more and tell me what has changed and how?

And if in addition you could give me, "the list of federal laws that have adopted the third option of its kind since the decision of the High Court," would have a great advance for me ...

After information from French lawyer, contrary to European law, there is no constitutional protection in Australia of privacy. However, federal law can play this role about the prohibition of discrimination. The Australian Supreme Court would have used the recast of the anti-discrimination law.

Also, could someone give me some legal references (number and references of laws) concerning articles of the federal law that have been used in the judgment of Norrie?

The High Court of Australia is the court in charge of any changes in the Constitution and also the highest court of appeal.

When you raise the issue of privacy protection and then talk about discrimination in the same sentence are you referring to protection against being discriminated against because of your gender ?

here is the Australian Government's legislation changes to be implemented by July 2016 by all Commonwealth Agencies and Departments by July 2016 for both customers and the departments staff.

Since Norrie's case was to allow her to define her gender as 'x'. The cases that you are wanting is that more for allowing persons to transition their gender? Because the cases Norrie has provided are for transgender persons rather than for the non-gender binary option.

I'm sorry for not being able to express myself better in English. Also, if you do not mind, I will write in French (je ne sais pas si je serai plus clair, mon bon... ;) ) :

Donc, ma requête est particulière en ceci que je fais une thèse en psychopathologie clinique (psychanalytique de surcroit) et que je recherche des informations en droit.

En fait, même si les législations européennes et australiennes ne sont pas les mêmes, et que j'ai bien compris que sous les juridictions du Commonwealth il n'existait pas de grands principes constitutionnels comme sur le vieux continent, je me dis qu'il doit tout de même exister quelques principes de bases qui donne a chacun le droit d'être ce qu'il est et qui fait tenir ensemble tous ces principes jurisprudentiels (pour donner un exemple, comme la déclaration universelle des droits de l'Homme, sans laquelle l'idée même d'égalité entre sexe, couleur, ethnie, etc. est impossible à concevoir). Vous comprenez ?

Aussi, je recherche la ou les lois, décrets, textes (nommez les comme vous le souhaitez) qui selon vous, dans l'histoire du droit australien, ont fait qu'aujourd'hui, Norrie puisse, légalement, se dire de genre non-spécifique.

Voilà. Je ne me permettrais pas de vous demander trop de travail, votre temps est précieux, simplement, quand vous pensez aux droits civiques et citoyens australiens, à quels principes incontournables pensez-vous en premier ?

En Europe, les associations Trans s'appuient sur l'article 8 de la Convention Européenne des Droit de l’Homme, en cas de difficultés de changements de genre à l'état civil, et qui dit : "Toute personne a droit au respect de sa vie privée et familiale, de son domicile et de sa correspondance." Donc, les états n'auraient pas leur mot à dire concernant ce droit privée au choix d'une sexuation. Qu'en est-il en Australie, sur quels grands principes légaux peuvent s'appuyer les associations Trans, intersexes...?
