I am doing a PhD research project at the Universiti Malaya. The main objective of my study is to give a deeper understanding of the context or factors that influence the documented (legal) foreign workers (Bangladeshi) moving toward undocumented. I want the syndromes of the said problem and explain the causes with a theoretical basis.

اذا كان التوثيق القانوني قائم على الغش او الاحتيال ، فأنه يؤدي الى الأحالة اي احالة وضع المهاجر الى التوثيق غير القانوني او غير الشرعي ، وفقا لنظرية الغش نحو القانون
No te puedo ofrecer una respuesta..pero si te puedo decir que toda persona tiene derecho a la igualdad...podrías partir de la teoría de los derechos fundamentales y analizar el contexto de cada país respecto a su normatividad. Espero haberte ayudarte en algo.
في ليبيا يوجد العديد من العمال البنغاليين الذين قدموا اليها بطرق غير شرعية من اجل العبور الى اوروبا بعد العمل لفترة من الزمن فيها، ويقع هؤلاء العمال في فخ شركات تستغلهم نظراً لضعف الرقابة في دولتهم حيث تعمل شركات الهجرة غير الشرعية على استغلال حالة الفقر لدى هؤلاء العمال لنقلهم بلا حماية قانونية لبلد اخر
Where there is any change in Law or any Policy of state legal framework.
There has to be a logical and accepted reason to move from documented to undocumented status. Within the Colombian and the USA context the reasons can be fraud, dishonesty during the application process. This does not necesarily mean you need to go back to undocumented status, you should just make an adjustment. There is no valid reason for anyone to be undocumented, you might be able to place the person in a temporary status until the problem is resolved taking the Human Rights into accounts.
