The EU projects are financed with EU money (our taxes, public money). The products are sometimes new diagnostic tools, psychometric instruments, diferent kind of software etc. which can be comercialised. What are yours thoughts about that. On one side is public money and reasonable request for free of charge availibility of any product. On other also reasonable posible source of further funding of academic science throughs patents or royalities.
EU projects are only partially funded by EU money. The rest of the funding comes from the partners, whether they are private industry or public research institutes.
I don't see any difference in how results from EU projects or those from national research council projects should be treated. This is different among countries, e.g. for university research. In some countries, the university owns the data, in others (as in Sweden) the data belong to the researcher. This is thought to give researchers an incentive to carry out research and exploit the results, e.g. by starting spin-of companies.
As a similar political decision, the EU wants to stimulate the European bio-economy and is willing to support a lot of research carried out by private industry.
It's hard to see why researchers should give away all their data for free just because it partly funded by the EU.
