Much is published about successes in driverless automobiles and other automations. Responsibility for accidents is not sufficiently discussed when AI is controlling. So far the owners and operators have been able to put responsibility on others.
This question is asking if the humans who designed, constructed, and programmed an automated system can ever be totally free of responsibility for results.
Some attempts have been made in the publishing field to put compliance of copyright into the responsibility of AI systems.

The problem is so important that humans must face on in the near future..
AI so far is still not evolved to an extent where it can avoid such accidents 100%.
When humans cause accidents they are held responsible and then it is first ascertained as to why the accident happened? "So called" deliberate or not? Issue. And based on that decisions are taken whether or not to penalize them.
If AI based systems cause accidents then there surely is fault in their implementation and fail safe algorithms.
If a fail safe AI is not employed then humans responsible for their implementation cannot be absolved.
