If a fresh PhD who is not currently affiliated to any institution wish to write a paper independently with his/her friends who are either student or also fresh PhD on a common topic of interest, what should be the affiliation for the person?
Is it going to be the last institute fro where the person got PhD?
Or they can write Independent researcher?
You can list either affiliation or both. It's legitimate to still cite the institution :)

I think you could list yourself as an alum or as an "independent researcher" ...
It is most correctly to put "Independent Researcher".
On that way, you will not have any problem/trouble/unpleasant situation with any institution.
For example, when I worked in private company, I always wrote disclaimer - opinions expressed in the paper are personal opinions of the author...
Now, I work at Faculty and I do not have that "problem".
He's an "independent researcher." His affiliation with the university of study is already ended.
Unaffiliated researchers were chosen because they lack the privilege of access to the wide range of scholarly literature usually made available through institutional subscriptions, but they proved to be an interesting group to study for other reasons.

Let me be clear, I am working with one such researcher. I do still have an affiliation. I had to get the best solution from the research community hence I chose RG.

I concur; the term "independent researcher" should be used ... or, depending on resources and purpose, the group could start their own little research organization ...
There is another query on ResearchGate asking the same question. There I also commented, "Independent Researcher."
Right you may write Independent Recserchar or took your last institute affiliation. Both are correct and one of them may be used.
