In my study, I got some mtDNA COI sequences previously, and those sequences data have been used in my published paper in July 2013, Now, I also got another gene sequences (new data), I want to combine all the data (including thosemtDNA COI sequences appeared in my published paper ) to analyse the genetic diversity, genetic structure of my insect materials, and I hope to publish another paper, I want to know whether it is academic misconduct?
It should be okay as long as you are completely explicit about where all of the data came from. In particular, since you already have published one paper with the data you can cite that paper. For example, "Mitochondrial COI sequences were obtained in a previous study (Gao et al., 2013). New sequencing data was generated for [insert gene name here] by [insert protocol here]."
Academic misconduct would be if you were reproducing the same analysis, figures, tables, and/or conclusions from a previous paper, but were misrepresenting them as being novel. Using old data for a new analysis and new conclusions is okay.
