Some of the problems that the ICC is currently facing include: the Leadership nature of the crime of aggression thus making it hard to prosecute heads of state due to the immunity they have, the ability of the state parties to opt-in and opt-out of courts jurisdiction, the fact that the court only has jurisdiction when the crime is committed by a state party against another state party and the fact that the act committed needs to be a manifest violation of the UN Charter by character, scale and gravity e.t.c
