Dear Colleagues, we are interested in studying the international regulations on the matter of respecting the religious and cultural heritage in Eastern European post-communist urban areas.
We plan to start our research from the assumption that at the local level of urban planning there were incremental changes in policy-making and loopholes in the legislation which allowed private Investments interests to speculate the legal void and thus consider building business/recreational centres in the near proximith of historical/religious sites/ old city centres.
At this point we need references on international regulation on urban planning with a view on historical preservation.

I would suggest there is no mandatory international agreement in it. Propably states which signed UNESCO contracts practice self-restrainment. Maybe you get some useful informations in the attached publication on the subjekt of museum artifacts.
While you are canvassing the subject, you may want too have have a look at the body of literature that relates to secondary use/adaptive re-use of churches and other religious buildings.

I'm somewhat familiar with The International Council on Monuments and Sites (ICOMOS) that has its headquarters in Paris, France. It's strictly advisory and there might not be any international law, only local ordinances on the protection of historical/religious sites. I'm guessing that there are thousands of examples of business interests destroying cultural heritage sites all over the world. This is certainly true of the United States of America.
The best single document which discusses the various buffer zones for CH monuments, sites, parks, etc is the UNESCO World Heritage Report #25 (attached here). The importance of implementing various regional and local stakeholders can never be under-emphasized. The UNESCO report is good for examining the aspects of buffers, corridors, etc. These are often only suggestions and recommended policies, but at least you have international codified policies to utilize.

The French Ministry of Culture has been holding multitudinary activities titled "Entretiens du Patrimoine" and they have eventually published all the papers read in them in thematic volumes that cover quite a lot of ground. Each volume includes the discussions prompted by the papers and are very helpful. They can be located in the net, but are pricey. Experts from all around the world have contributed to these "entretiens". I have bought quite few of these volumes and find them very useful and valuable because of the huge diversity of sources and positions on key conservation/adaptation issues. There is also the impressive amount of material published by UNESCO in Paris concerning key issues on the process of locating, describing, and submitting heritage sites to UNESCO's famous and useful World Heritage List (WHL). You can go to that list and will find there, under each list entry all the documentation submitted by the proponent country during the process of placing specific sites on the WHL.
A few years back, I wrote a critical analysis on how countries use the WHL for political reasons and for promoting international relations and country branding abroad to attract tourism. It is written in Spanish, and was originally published in an Architectural Journal. Even if you cannot read Spanish, you could find the bibliography useful. Thanks for your question; it is very important matter to put efficient process for conserve urban heritage in historic cities. The issue is tearing many communities, cultures, countries, religions.
Meanwhile, may be it is helpful for you some paragraphs from the abstract of my last research.
