COPRA 1986 mandate that a case filed before the Consumer Forum should be disposed in 90 to 150 days. But cases of medical negligence have been decided in years / even decades. Is it not a cheating with the India Consumers of Healthcare?
Delayed justice is harmful to both parties to dispute i.e. doctors/hospitals on one side and patient community on other side. Due to dragging of cases amount of compensation also increases with passage of time as interest on compensation awarded also multiplies. Example Kunal Saha case of 11.6 Crore compensation where interest amounts to 5.6. Crore
Lack of accountability, lack of resources, lack of awareness about rights and mechanism for their enforcement. Here research plays an important role in enforcement through PIL.
Definitely delayed disposal of cases cause harm to both the parties, in terms of financial, psychological, improper use of resources and loss of time etc. etc...
