Ηuman rights that are not absolute are harder to assert. Dismissibiliy is a matter or circumstances, region of application and other factors.
But generally, absolute ones do not get dismissed by claims such as "violation of rights of others by assertng one's rights"

Define "dismissable" please. Is the procedural meaning under form of defense or motion opposed to to a claim? Or a generic overview/criteria in order to separate what is relative and what is absolute among freedoms, liberties and rights.
Individual rights are an important part of any society, and they are not completely dismissive under the notion that they are not absolute. While there are certain circumstances where individual rights may be limited for the greater good of society, such as in cases of public safety or national security, most democratic societies strive to protect and upload the rights of individuals to the fullest extent possible. These rights are often subject to laws and regulations that aim to strike a balance between individual freedom and the common good.
There are various type of individual rights. We could talk about fundamental rights and non-fundamental rights. In any case, the human rights (described as they are in the European Convention on Human Rights) are universal and anybody can report a human rights violation to the European Court of Human Rights. As Philippos said above the difficulty lies in the assessment process of this violations. There are some factors, such as the subsidiarity principle (meaning by this that the complainant should report the violation via its own country law courts), that dull the binding recognition of the human rights. So we would be talking about procedural obstruction. But of course, there are some exceptions to the subsidiarity principle.
In any case, any person in the world (doesn't matter if the country of origin is a non-member of the European Convention) could assess her/his human rights via the European Court of Human Rights.
