In India, right to practice goverened by the Indian Medical Council (Professional Conduct, Etiquettes and Ethics) Regulations, 2002, under the Indian Medical Council Act, 1956 and now the Natioanl Medical Commission Act, 2019. Training in any speciality, whether entitle a plan MBBS to practice that speciality is a question for discussion, especially in medical negligence cases.

I think as of today in India, there is no debate with the proposition that to be qualified as an anesthesiologist, an MBBS graduate should either obtain an MD degree in anesthesia or a Diploma in anesthesia. But the crux of the issue raised in a criminal negligence case (Philip Thomas v. State of Kerala & Ors. 2023) is whether a doctor who graduated MBBS and underwent sufficient training in anesthesiology is competent to administer anesthesia for laparoscopic sterilization.
It is observed that the Research Studies and Standards Division, Ministry of Health and Family Welfare, Government of India, in October 2006 specified the qualification of a doctor to give anesthesia for sterilization procedure, i.e. Proper training in administering anesthesia (four months of training prescribed by the department of Health Service either in medical college or in major hospitals). The doctor in question had undergone one-year training in a Medical College in Trivandrum after MBBS. Hence, in the said case the doctor was acquitted of the criminal charges.
However, the Hon'ble High court of Kerala has stated that the civil liability will be dealt with accordingly in the appeal before National Commission and this judgment will not have any bearing on it.
