of research results on the issue of climate and environmental security, the accelerating process of global warming generated by civilization's greenhouse gas emissions, the increasing scale of the negative effects of the climate crisis, the decreasing scale of human security, the increasing importance and scale of the implementation of the goals of sustainable development and the need to accelerate and increase the efficiency of carrying out the green transformation of the economy, I propose a discussion on the above topic. The research shows that one of the important factors in the increase in the importance and scale of the implementation of the Sustainable Development Goals and the need to accelerate and increase the efficiency of carrying out the green transformation of the economy, reducing greenhouse gas emissions, slowing down the process of the planet's greenhouse effect, slowing down the process of global warming, which continues to progress faster and faster, reducing the scale of droughts, forest fires, water shortages, declining production of agricultural crops and other negative effects of progressive and human-induced climate change is to recognize human security as an important factor in the context of legislation and to recognize the issue of ensuring climate and environmental security as an important element of basic human rights. In view of the above, the issue of ensuring climate and environmental security should become part of basic human rights. In my opinion, there is one fundamental doubt.
If we take into account the current human rights paradigm, namely that human rights correspond to state obligations, the question arises whether the state is able to ensure a healthy natural environment.
We should bear in mind that a healthy natural environment depends on coordinated actions of various public and private entites.
Moreover, these actions occur in dimensions such as maritime, land, space etc.
No single state has jurisdiction over all public and private entities in all these dimensions wheares a state should ensure respect for human rights (and is able to do so) within its jurisdiction.
In 2014 I published a paper that argued human rights exist within the living eco-sphere and are completely dependent upon the living eco-sphere. Normally in (American) law, the right to a healthy environment is considered an emergent human right, one that is not easily protected nor enforced. But in fact the relation between those must be acknowledged with Gaia (the living eco-sphere) as encompassing and enabling human rights rather than the opposite. Humanity evolved within Gaia and is dependent upon Gaia. That is the simple truth.
Alas, the collective governance difficulty does not bode well for the future of humanity vis-a-vis Gaia. Humanity, under capitalistic systems, is driven by rapacious greed.

My answer to your first question is "Yes" and it already is. By my reading of human rights law as an international lawyer, environmental rights already became an implicit part of the human rights framework with the signing of the UN convention on elimination of genocide in 1949 and was also implicit in the UN charter goal of security and I have published a number of pieces specifically on how to hold nations accountable to this law and how to implement it ("A Treatise on International Development Law", "A Sustainable Development Indicator," "Accounting for Threats to Sustainable Development," "Accounting for Progress and Regress in Human Rights," "Why We Need a Cultural Red Book", and others that are on my ResearchGate page). Declarations and Conventions following this have started to elaborate on the specifics, but the SDGs is definitely NOT one of them since the SDGs actually reverse many existing international law protections for sustainability and the environment under the name of "sustainability".
My answer to the second question is, "Yes, we need additional professional clarity in enforceable international law measures, BUT THE SDGs ARE NOT ONE OF THEM since the SDGs actually undermine sustainale development." (I have published on how the SDGs violate international law and the international human rights framework ("Testing the Global Community's Sustainable Development Goals") and have also clarified what development goals are consistent with international law ("Universal Development Goals" including protecting cultures in their environments) in pieces you can also find on my ResearchGate page.

The problem is not whether it should become. It is now. As far as I know, they belong to so called third generation rights. They are policy goals. The issue is how appropriate behavior of states can be enforced.

From the results of a number of bibliographic studies, it appears that in recent years the importance of sustainability issues is growing, people's awareness of the issues of green circular economy, the implementation of the Sustainable Development Goals, environmental and climate social responsibility, the green transformation of the economy, including the development of renewable and zero-carbon energy sources, etc., is growing. This is a good thing, because the question of saving the climate, the biosphere and the biodiversity of natural ecosystems for future generations of people depends on to what extent and in what time the green transformation of the economy can be realized. May this be realized effectively in the shortest possible time in the coming years, and may we succeed in stopping or at least significantly slowing down the process of global warming, which has been progressing ever faster since the first industrial revolution, and may we succeed in avoiding a global climate catastrophe or at least significantly reducing its scale and preparing well for it. For the New Year 2024, I wish to increase the scale and accelerate the processes of green transformation of the economy, significantly increase the scale of implementation of the goals of sustainable development, environmental and climate social responsibility, etc. I hope to develop good cooperation in the next 2024 and beyond.

I agree with everything in your question, but this particular sentence really struck home with me. It's really frightening to think that action might not be taken in time.
