We have extracted the crude phytoconstituents from a marine algae and used them as surfactant for drug delivery system. The crude has better surfactant potency than the isolated compounds. Can we commerialize/document the crude extract of the algae as surfactant?
Yes, you can; however, you need to treat it as novel excipient, meaning you need to do a full characterization and tox study as it was an API.
It may be necessary to know the exact composition of the extracts. You may not be able to tell which exact or which combination of extacts are causing the better surfactant property. Unless you resolve this it may be difficult to commercialize the product. In addition as noted by Andrie Blasko you need to do full characterization and tox studies to show safety and its usefulness.
